1. GENERAL
1.1.The mission of European Centre Golf Club (hereinafter referred to
as the Club) is to offer its Members and their Guests the opportunity
to enjoy the game of golf, as a sport (exercise and competition), as
recreation, and as a place for social meetings, both private and
business. When possible allow other Guests to enjoy the game of golf.
1.2. The Club is situated in a picturesque area covering 83 ha in the
vicinity of the geographical centre of Europe, in Girijos Village
(Vilnius District). The Club has an 18-hole course, practice areas,
Clubhouse with changing rooms, leisure areas, a restaurant, and a shop.
UAB Golf Development (enterprise code 3001 18852 with headquarters
registered at Jogailos St. 4, Vilnius, hereinafter referred to as the
Company) is the owner and manager of the Club.
1.3.The present Statutes of European Centre Golf Club (hereinafter
referred to as the Statutes) set the conditions for persons and
companies that are or want to become Club members, the rights and
obligations of the Club Members, Guests, Visitors, and Staff, the scope
of services provided by the Club, and other issues. These issues are
also governed by the Membership Agreement, the Rules of the Game of
Golf set by R&A St. Andrews Golf Club, and any local rules of the
game approved by resolution of the Company Board, the Rules of
Etiquette, and other internal documents.
1.4.All Club Members, Guests, Visitors, Staff, and other persons shall abide by the Statutes when on the Club premises.
2. DEFINITIONS
2.1. The terms used in the Statutes, including the general provisions,
have the following meanings unless otherwise demanded by the context:
The Club:
The Club consists of Memberships, Members, an 18-hole golf course,
practice areas, a club house, and other facilities situated 26 km from
Vilnius in the vicinity of the geographical centre of Europe, in
Girijos Village, having an area of approximately 60 hectare. The club
is managed and administered by the Company.
Membership:
A private or legal person’s right to play on the Club’s Golf Course and
use other services provided by the Club, or to appoint someone else to
use the rights of Membership acquired on the basis of the Membership
Agreement and paid Fees. The physical person appointed to use the
rights is called a “Member”.
Membership Agreement:
An agreement signed by both the Membership Owner and the Club in accordance with the procedure set by the Statutes.
The Annual Members Meeting:
A regular or extraordinary general Meeting of the Club for the Membership Owners, having competence defined in the Statutes.
The Member:
A physical person (a player) appointed by the Membership Owner on the
basis of a Membership Agreement in accordance with the procedure
defined in the Statutes. The appointed person must be the same for the
whole calendar year.
Member categories:
Honorary Member, Junior, under 18. Junior until the year he or she becomes 21. Senior Members from 21 years and up.
Entrance Fee:
A one time payment to acquire a Membership. It is possible to trade the Membership in accordance with the Statutes.
Joining Fee:
The one time Fee paid by the Membership Owner to register a physical
person as the user of the services (a Member). This Fee is paid every
time a new physical person is registered as a player (a Member).
Annual Dues:
Annual Dues paid by the Membership Owner for the right to use the facilities of the Club, in accordance with the Statutes.
Company:
UAB Golf Development, managing the Club (enterprise code 3001 18852
with headquarters registered at Jogailos St. 4, Vilnius). The Annual
Meeting of the Company appoints the Board.
Board:
The Company’s Board acting in accordance with the legislation of the
Republic of Lithuania, the Company’s Constitution, the Statutes, and
other internal legal documents of the Club. The Board sets the
guidelines for the Director.
Director:
The Company’s Director acting in accordance with the legislation of the
Republic of Lithuania, the Rules, and other internal documents of the
Club shall bear direct responsibility for managing and supervising the
Club.
Administrative Staff:
Host the reception for the benefit of Members and Guests.
The Golf Course:
The playing area consisting of tees, fairways, roughs, hazards, and greens only limited by out of bounds markers.
Driving Range:
The defined practice area for the long game.
Putting & Chipping Green:
The defined practice area for the short game.
The Shop:
The shop is supervised by the pro, has golf equipment for sale or lease, and can provide Members and Guests with repair service.
The Head Pro:
A professional player and trainer that has the sole right to give
lessons (by himself or through the Assistant Pro) at the Club, the Pro
is also the highest authority regarding questions relating to the game
of golf, i.e. the rules and etiquette of the game.
Caddie:
A person that assists the player by carrying his or her bag and giving
him or her support during the play. As defined in the Statutes.
Guests:
Non-members that play the course or use the practice facilities, as defined in the Statutes.
Visitors:
Other persons visiting the club for reasons other than playing golf.
Green Fee:
A Fee set by the Board for playing the Golf Course.
Handicap:
Worldwide system rating the skills of golfers.
Peak Hours:
Playing hours when more players are expected than the course and practice facilities can handle.
Greenkeeping Staff:
Employees of the Club responsible for the maintenance of the course and practice facilities.
Tee Time:
A permit issued by the Staff to start a round of golf from tee 1 or 10
on the course, under the conditions specified in the permit.
3. SERVICES PROVIDED AT THE CLUB 3.1.Members,
Guests, and Visitors can use the services provided by the Club in
accordance with the procedure set in the Statutes.
3.2.Members and Guests are entitled to use the Golf Course, the
practice areas, and the Clubhouse with equipped men’s and women’s
changing rooms, a Golf Shop, a restaurant, and a leisure area if they
comply with the Statutes of the Club. Guests and Visitors can be
subject to restrictions that do not apply to Members.
3.3.The real estate within the Club area (the land, the Club
structures, etc.) and the movable property (equipment, machinery, etc.)
are the Company’s property.
3.4.The Company shall organise provision of all services at the Club,
except in cases when the Company has concluded agreements regarding
provision of certain services with third parties. In the case of a
third party providing services in accordance with an agreement with the
Company, this party shall be responsible to the Membership Owner, the
Members, and other persons.
4. CLUB MANAGEMENT
The Club is the Company’s structural unit. The Annual Members Meeting
of Club Members, which is a consultative body of the Director and the
Board, discusses all strategic issues related to the Club. The Board
discusses and solves the most important issues related to the Club. The
Director of the Club directly heads the Club.
Company management:
4.1.The stockholders’ general Meeting, the Board, and the Director are
the Company’s governing organs. They have competence and functions set
forth in the Company’s Constitution. The issues of summoning of
meetings of the Company’s governing organs, a quorum, and
decision-making are governed by the Company’s Constitution and the
legislation of the Republic of Lithuania.
4.2.In addition, the Company’s governing organs solve issues related to activities of the Club’s management as described below.
Club management
Klubo valdymas:
4.3.The Club is the Company’s structural unit managed by the Annual Members Meeting, the Board, and the Director.
Annual Members Meeting:
4.4.The Annual Members Meeting is the Club’s highest organ, which
solves issues attributed to its competence and submits recommendations
to the Director and the Board concerning all important issues related
to the Club activities. The Annual Members Meeting fulfils the
functions listed under 4.4.1.– 4.4.7:
4.4.1.Approves the Standing Orders of the Annual Members Meeting;
4.4.2.Elects the chairperson and secretary of the Annual Members Meeting;
4.4.3.Discusses and submits recommendations to the Board regarding the Annual Fees;
4.4.4.Submits, if necessary, recommendations to the Director as regards new or additional Staff;
4.4.5.Submits recommendations to the Director as regards additional services and/or improvement of service quality;
4.4.6.Sets up, if necessary, various Club committees;
4.4.7.Submits other recommendations related to the Club activities to the Board and the Director.
4.5.All Membership Owners who paid the Entrance Fee, the Joining Fee,
and Annual Dues in full are entitled to participate in Members
Meetings. Honorary Members and Members under the age of 18 years are
not eligible to vote at Members Meetings. The Director and Board
Members can take part at the Annual Members Meetings with a
deliberative vote. The Membership Owners participating at the Annual
Members Meeting are registered in the Meeting List (also acting as the
voting ledger).
4.6.A regular Annual Members Meeting shall be convened within two
months after the end of every calendar year. A regular Annual Members
Meeting shall be held on the last Saturday of the designated month. The
Director shall convene regular Annual Members Meetings.
4.7.The summons shall include:
4.7.1 The election of a Chairman of the Meeting;
4.7.2 The election of a Secretary of the Meeting;
4.7.3 The Director’s financial review;
4.7.4 The Board’s suggestion of Annual Fees and Joining Fees for the year;
4.7.5 The election of the Member representative(-s) in the Board of the Company;
4.7.6 The plans for the coming year;
4.7.7 Suggestions from the Board;
4.7.8 Suggestion from individual Membership Owners.
4.8.The Director shall have the right of initiative to convene an
extraordinary Annual Members Meeting. The Meeting shall be convened not
later than 40 days after the initiative was taken. The initiators of
the Meeting summoning shall submit a proposed agenda of the Meeting to
the Director. The Meeting agenda can be supplemented during a Members
Meeting if so proposed by any Member, provided that 1/3 of the Members
participating in the Meeting approve of it.
4.9.The Director shall inform every Membership Owner about a regular or
extraordinary Meeting being convened in writing, by fax, email or
telephone 30 days before the Meeting date, and shall advise of the day,
time, and place of the Meeting, and of the proposed agenda.
4.10.A chairperson and secretary shall be elected at every Members
Meeting. The chairperson shall lead the Meeting. Minutes shall be taken
of Members Meetings. The secretary shall be responsible for taking the
minutes of the Meeting.
4.11.The Members Meeting discusses and adopts issues by a simple majority vote, unless the Members Meeting otherwise resolves.
4.12.The procedure of convening and chairing the Members Meeting, as
well as voting and other issues are set out in the Standing Orders of
the Meeting adopted and confirmed by the Members Meeting.
Club Board:
4.13.The Club Board makes decisions regarding the following issues related to the Club’s activities:
4.13.1.Sets requirements the persons desiring to become Members must meet;
4.13.2.Grants the title and status of an Honorary Member;
4.13.3.In view of the opinion of the Members Meeting, decides on the
size of the Entrance Fee, the Joining Fees, and changes it;
4.13.4.In view of the opinion of the Members Meeting, decides every
year before the 31st of January on the amount of the Annual Dues;
4.13.5.Decides on of the Green Fees for the coming year;
4.13.6.Approves the Rules of Etiquette, the local Rules of the Game of
Golf, as well as the form of Membership Agreement and other internal
legal documents of the Club;
4.13.7.Resolves other issues attributable to its competence by the Rules or other internal legal documents.
Director:
4.14.The Director is in charge of the Club and solves the following issues related to its activity:
4.14.1. Supervises and is responsible for the procedure of becoming a Membership Owner;
4.14.2. Concludes Membership Agreements on behalf of the Club;
4.14.3. Issues or authorises another member of the Staff to issue Tee Times;
4.14.4. Considering the individual Membership candidature and objective
reasons, authorises the Entrance Fee to be paid in instalments over a
certain period of time or reduces the size of the Fees;
4.14.5. Administers appropriate payment and collection of the Entrance Fee, Joining Fee, and Annual Dues;
4.14.6. Approves and administers the change of the physical person to exercise the right of the ownership of a Membership;
4.14.7. Convenes Annual Members Meetings;
4.14.8. Ensures the quality of services provided at the Club;
4.14.9. Socialises with persons visiting the Club;
4.14.10. Does his or her best to solve the issues and problems arising
for persons visiting the Club, in a prompt and responsible manner;
4.14.11. Solves other issues attributable to his or her competence by the Rules or other internal legal documents of the Club.
Club Staff:
4.15. Technical employees (instructors, administrators, etc.) servicing
the Club activities comprise other Staff. The Board approves the number
of Staff proposed by the Director considering the recommendations of
the Members Meeting.
5.PROCEDURE OF GRANTING MEMBERSHIP
5.1. There can only be 1000 Memberships issued, in excess there can be a special quota of Junior and Honorary Members.
5.2. The Director supervises and bears responsibility for the procedure of Membership granting / sales.
5.3. Natural persons and legal persons (companies) meeting the requirements set by the Board can become Club Members.
5.4. A person desiring to become a Club Member must fill in an application and hand it to the Director.
5.5. A person who hands in a Membership application:
5.5.1. Undertakes, if the Club Board approves of his or her
candidature, to conclude a Membership Agreement and to pay the Entrance
Fee;
5.5.2. Agrees that his or her application will only be granted if the Board agrees to it;
5.5.3. Agrees that the Club will only provide services if her or she
pays the Entrance Fee, Joining Fee, and Annual Dues as required;
5.5.4. Confirms that he or she is acquainted and agrees with all the
rules valid at the Club including the present Rules, the Rules of the
Game of Golf, and the Rules of Etiquette;
5.5.5. Verifies that the details submitted in the application are full and correct.
5.6. The Club Membership is registered at the Club with both the holder
(owner) of the Membership and the person who is the acting player (the
Member) at any given time.
5.7. The Club shall, after the 1000 Memberships are sold, keep a list
of persons or companies that want to be members so a holder of a
Membership shall have a natural way of locating a buyer if a person or
company wants to sell their Membership.
5.8. If the application is granted, the applicant shall within 15 days
conclude a Membership Agreement and hand one signed copy of the
Agreement to the Club Director. The Membership Agreement must be of the
form approved by the Board.
5.9. A person is granted Membership upon payment of the Entrance Fee,
Joining Fee, and Annual Dues for the first year of Membership. After a
person pays the Entrance Fee, Joining Fee, and Annual Fee, he or she is
issued a Member Card.
6. MEMBERSHIP AND MEMBERS
6.1. There are three categories of Memberships in the Club:
6.1.1. Full Membership (granted to natural persons and/or legal
persons), maximum of 1000. They have to appoint a physical person that
will be the acting Member and that has the right to play.
6.1.2. Junior Memberships, maximum 100 Memberships. If the Board, after
consulting the Annual Members Meeting, finds that the quota can be
increased, these shall be offered to children of full Members. A Junior
does not pay an Entrance Fee. The size of the Joining Fee and Annual
Dues is determined by the Board after recommendations by the Annual
Members Meeting. The year in which a Junior turns 19 years old he or
she must acquire a Full Membership or an Honorary Membership in order
to remain a Member. When the quota of Juniors is filled, the club will
maintain a waiting list for Juniors, which shall be offered a Junior
Membership when a place is available.
6.1.3. Honorary Memberships can be offered to persons that have made a
truly special effort for the Club or for golf as a sport or for the
country of Lithuania. The issue of Honorary Memberships shall always be
restrictive and shall always be approved by the Board after consulting
the Annual Members Meeting.
6.2. The Board can, at its discretion, limit the number of Memberships
at any time. In the event the Club builds additional holes, the number
of Memberships may be increased by the Board’s decision.
6.3. Every Full Membership Owner enjoys the following rights (Honorary
and Junior Memberships are personal and only provide the rights set out
by the Board):
6.3.1. The physical person appointed by the Membership Owner may use
all the services provided by the Club in accordance with the Statutes
and only limited by maintenance of the facilities, the weather, and
activities that require special invitations or skills, i.e.
competitions with a handicap limit;
6.3.2. To transfer Membership in accordance with the procedure defined in the present Statutes and other Club documents;
6.3.3. To lease out the right to play (change the member) to a third
party. If The Director agrees the new member can pay the Joining Fee
and the Annual Fee, but this does not relieve the Owner of the
Membership from their obligation to fulfil the payments if the member
does not pay. A change of player (member) can only be done for a full
calendar year and has to be submitted to the Director before the end of
the year prior to the year of the change;
6.3.4. To take part at The Annual Members Meetings and to vote in accordance with the rights granted by the Membership;
6.3.5. Upon submitting a request in writing, to receive information on
the Club activities, provided that the requested information does not
constitute a commercial secret;
6.3.6. The physical person (Member) appointed by the Membership Owner
can take part in tournaments, competitions, and other events organised
by the Club in accordance with the procedure set by the Club;
6.3.7. The physical person (Member) appointed by the Membership Owner
to reserve in advance Tee Times in accordance with the procedure set by
the Club;
6.3.8. Through the physical person (Member) appointed by the Membership
Owner, to reserve the Club restaurant for his or her own needs and to
have private parties there in accordance with the procedure set by the
Club provided that it does not interfere with the leisure of other
persons visiting the Club at that time;
6.3.9. Through the physical person (Member) appointed by the Membership
Owner, to invite Guests in accordance with the procedure set by the
Club;
6.3.10. To suggest ideas as regards improvement of the Club activities;
6.3.11. Other rights set forth in the present Statutes and Membership Agreement;
6.3.12. All Membership Owners are registered in the Membership
register, where the following details are recorded – the Membership
Owner’s name, contact information (address, telephone and fax numbers,
and email address), the date of Membership granting/transfer, and the
category of Membership;
6.3.13. All Members are registered in the Member Register, where the
following details are recorded – the Member’s name, contact information
(address, telephone and fax numbers, and email address), the date of
Member granting/transfer, and the category of Membership;
6.4. Club Members understand that initially the Club may offer other
persons all kinds of discounts and incentives with a view to promoting
Club Membership and attracting other persons to participate in the Club
activities. The Club will decide on the character, procedure, and
duration of such discounts and incentives at its discretion.
7.PROCEDURE OF MEMBERSHIP TRANSFER
7.1. Full Membership can be sold or otherwise transferred to third
persons in accordance with the procedure set forth in the Statutes and
Membership Agreement. Members understand and confirm that in the event
of the Membership being sold or transferred in violation of the
procedure set forth in the Statutes and Membership Agreement, the Club
will not recognise the validity of such Membership transfer, and that
the Club will assume no liability in this case.
7.2. A Member desiring to sell or otherwise transfer their Membership
must advise the Club in advance by submitting notification in writing.
In the notification the Member must indicate the price (in the event of
selling the Membership), as well as the details of the person/company
he or she intends to transfer the Membership to.
7.3. The Club will in all cases have the priority right in acquiring
the Membership being sold or transferred in some other manner. The Club
may purchase the Membership for the same price that the Member has been
offered. The Club may use the priority right within 30 days from the
receipt of the Member’s written notification of his or her intent to
sell or transfer the Membership in some other manner.
7.4. In the event of the Club relinquishes its priority right to
acquire a Membership or fails to answer the Member in 30 days from the
receipt of the Member’s written notification of his or her intent to
sell or transfer their Membership in some other manner, the Member is
entitled to sell or transfer their Membership in some other manner to
another person provided that they comply with the conditions listed
under items 7.4.1.-7.4.3.:
7.4.1. The candidate fills in an application and submits correct and full details;
7.4.2. The Club Board does not object to the Membership transfer;
7.4.3. Prior to the Membership transfer, the candidate undertakes to
pay the Joining Fee, to pay the Annual Dues, and to comply with all the
rules valid at the Club, including the present Statutes, the Rules of
the Game of Golf, the Rules of Etiquette, and other internal legal
documents.
7.5. In the event of a Member’s death, Full Membership is inherited in
accordance with the procedure set forth in the laws of the Republic of
Lithuania. The inheritor desiring to use the services provided by the
Club in accordance with a Full Membership, must advise the Club Board
of this and obtain its permission. The inheritor has to pay the Joining
Fee, the Annual Dues, and fulfil all obligations that come with a Full
Membership. Honorary and Junior Memberships cannot be inherited.
7.6. In the event of liquidation of a Corporate Member, its Membership shall not be transferred to other legal persons.
8. HONORARY MEMBERS
8.1. The status of the Club’s Honorary Member is granted by the
decision of the Club Board to Lithuanian and/or foreign citizens having
special merits in the area of playing golf or other merits to Lithuania
and the world.
8.2. An Honorary Member is issued a certificate to the effect that he or she has been granted the title of an Honorary Member.
8.3. Honorary Members are obliged to pay an Entrance Fee, Joining Fee,
and Annual Dues set out by the board. They enjoy the same rights as
Members, however, they: a) cannot vote at Members Meetings; b) cannot
transfer their Membership or the right to play to other persons.
Honorary Members are entitled to receive information about the
functions organised by the Club for its Members, and to submit
proposals as regards improvement and widening of the Club activities.
9. JUNIORS
9.1. The status of the Club’s Junior Members is granted by the decision
of the Club Board. It can only be 100 Juniors unless the Board decides
otherwise after consulting with the Annual Members Meeting, and they
shall be children of Members. If the quota of 100 Juniors is not
filled, the Board has the right to let Juniors without parents playing
golf to be Members, but only for one year at a time to secure that the
Members’ rights are not compromised.
9.2. A Junior is under the age of 18. From the year the person turns 19
years old they are considered to be a Junior and have to acquire a Full
Membership or an Honorary membership to continue to be a Member.
9.3. A Junior member is issued a certificate to the effect that he or she has been granted the title of a Member.
9.4. Junior Members are obliged to pay a Joining Fee and Annual Dues
set out by the Board. They enjoy the same rights as Members, however,
they: a) cannot vote at Members Meetings; b) cannot transfer their
Membership or the right to play to other persons.
9.5. Junior Members are only entitled to receive information about
functions organised by the Club that are relevant for Junior players,
and they are not able submit proposals as regards improvement and
widening of the Club activities.
10. GUESTS
10.1. A Guest must be a member of another golf club that is a member of
a golf federation and either have an official handicap of 36 or be the
holder of a certificate of 36+ (or equivalent, green card, etc.)
10.2. Full Members are entitled to invite two Guests per day, who will
receive a discount on the Green Fee. If the Member invites more than
two Guests, the others must pay the normal Green Fee.
10.3. The Member who has invited a Guest will be fully responsible for the behaviour of the Guest.
10.4. The Director’s authorised representative can also invite Guests
with a view to raising the Club’s prestige or attracting new members.
10.5. Guests are entitled, upon payment of the set Green Fee, to play
golf on the Club course and use other services provided by the Club.
10.6. A Member’s child (children) who is a Junior (under 21 years) may
play together with their parents regardless if they are members of
another golf club against the payment of the Green Fee, if they meet
the skills required by the Club.
10.7. The Staff may refuse to provide services to Guests and Juniors who do not obey the Rules of Golf or the Statutes.
10.8. Guests that are not Guests of a Member can/will at peak hours
find themselves subject to limitations in accessing the course,
practice areas, and other facilities.
11. CADDIES, CARTS, AND TROLLEYS
11.1. The Club sets the procedure for the training and registering of caddies.
11.2 Members and Guests have the right to use Caddies when playing at the course.
11.3 Caddies shall be regarded as with the player and are the responsibility of the player.
11.3.1 Carts and Trolleys can be used at the course, unless the
condition of the course or the weather makes it impossible to use them.
12. VISITORS
12.1 Visitors can enter the Club and use the facilities, i.e. the
restaurant, after obtaining the permission of the Director or
administrative Staff.
12.2 The Staff may refuse to provide services to Visitors who do not obey the Statutes, Rules or the etiquette.
13. CLUB DUES AND FEES
13.1 The Club Board sets the nature and size of Club Dues and Fees by its decision.
13.2 The Club Board sets the size of the Entrance Fee and the Joining
Fees by its decision. The Member must pay the Fees within 30 days after
conclusion of the Membership Agreement. The Director, considering the
individual Member’s candidature and other objective reasons, may decide
that the Entrance Fee and the Joining Fees can be paid in instalments
over a certain period of time or reduce the size of the Fees.
Reductions in excess of 10% and payments in instalments exceeding one
year shall be made by the Board.
13.3 The Club Board sets the nature and amount of the Annual Dues by
its decision considering recommendations of the Members Meeting. The
amount of the Annual Dues shall be set not later than the 31st of
January. The Annual Dues shall be paid within 30 days after an invoice
is sent to the Member (personal or legal).
13.4 If a Member does not pay on time, a letter will be sent to the
Member stating that if payment is not received within 30 days the Club
has the right to sell the Membership to the first person in line for a
Membership. The sales price minus 15% shall be forwarded to the
expelled member within 60 days of the sale.
13.5 When a Membership is sold by the Club, the amount of the Annual
Dues shall be proportionate to the number of months remaining until the
end of the season (the 15th of April to the 15th of October) in which
the Member signed the Membership Agreement.
14. TEE TIMES
14.1.1 From 08:00 to 18:00 daily, starting times will be every 10
minutes or as otherwise decided by the Director (called a Tee Time).
Every second Tee Time can be pre-booked (8:00, 8:20, 8:40, etc.), and
every second Tee Time will be available for booking the same day (8:10,
8:30, etc.).
14.2 Tee Times are booked in the reception of the club.
14.2.1 Full Members and Honorary members have the right to book two Tee
Times in advance (regardless of the time in advance), and they can book
two additional Tee Times as early as four days in advance.
14.2.2 Junior members can only book one Tee Time in advance and one additional Tee Time two days ahead.
14.2.3 Guests can book one Tee Time four days in advance and one
additional Tee Time one day in advance. The Director or person
appointed by them can grant golf tourists from other countries the
opportunity to book more than one Tee Time and more than four days in
advance.
14.2.4 Before 8:00 and after 18:00 only Members and their Guests can
access the course and there will be a physical queue system in
operation.
14.2.5 At least 15 minutes before the Tee Time the players shall
register in the reception. The Green Fee shall be paid for Guests
before entering the course. Upon request the player must be able to
confirm his or her membership in a golf club and provide verification
that their playing skills meet the regulations of the Club (Handicap or
green card, etc.)
15. INTERNAL REGULATIONS
15.1 Dress Code
15.1.1 All persons visiting the Club shall dress in a proper fashion.
While on the course they must wear golf shoes with soft-spikes or
smooth-soled shoes. Women should have slacks, long or medium shorts or
a golf skirt, and a proper top. Men should wear slacks or knee-length
shorts and a collared short- or long-sleeved shirt. 15.1.2 Short
shorts, denim wear, bathing suits, collarless shirts, training clothes,
and similar casual attire are not permitted at the Club. The Staff is
entitled to bar from the Club persons whose wear/footwear does not
comply with the requirements of the Rules.
15.2 Respect 15.2.1 Persons visiting the Club must behave
respectfully with one another and the Staff. If a person visiting the
Club believes a Staff Member’s conduct is inappropriate, he or she can
advise the Director of it. If the behaviour of a person visiting the
Club does not conform to the requirements of the Rules or Statutes, the
Staff may refuse to provide services to the person or demand that he or
she leave the Club premises.
15.3 Members have the priority right to play golf in respect of other
persons (set out by the right to book Tee Times). Other limitations for
Guests can from time to time be made for the benefit of the Members.
15.4 Learning and practising golf is only allowed in the areas of the
Club course expressly assigned for the purpose (practice grounds). The
times of training practice and lessons must be co-ordinated in advance
with the Staff.
15.5 Players at the Club must replace divots, repair ball marks on the
greens, and rake the bunkers when visited, so that the course remains
in adequate condition. The player’s duty is to put the course in order
as much as he or she can and leave it in the same condition in which he
or she found it prior to the game.
15.6 A player that flagrantly fails to respect the Staff, the course,
the rules or the etiquette of golf can be taken off the course and
barred from future play at the course.
15.7 The Greenkeeping Staff have priority in maintaining the course and
they are entitled to temporarily close the Golf Course, or part of it,
if it is necessary to remove obstacles, to repair damage or to make
other repairs or maintenance that cannot be put off.
15.8 It is not allowed without the Director’s written permission to put
up or circulate commercial or promotional notices, erect stands, spread
political propaganda, etc. anywhere on the Club premises.
15.9 The Director’s approval must be obtained to organise and conduct
all special events (i.e. sponsors’ prize tournaments, corporate
tournaments, golf tours).
15.10 Persons (except the Club guards) are not allowed to bring
firearms and other weapons or other hazardous materials into the
Clubhouse or onto the Golf Course.
15.11 Pets are not allowed in the Clubhouse or on the course. Pet
owners have the responsibility that their pet does not cause any
inconvenience for other players or visitors.
15.12 The Club has the exclusive right to conduct sales on all premises
of the club. The Director can give a third party the exclusive right or
none exclusively to temporarily or permanently conduct sales on the
premises.
15.13 A person who has damaged property belonging to the Club shall pay
for the damage done, unless the Director decides otherwise.
15.14 The Club shall bear no responsibility for any property brought to the Club premises that is lost or damaged.
16. OTHER RULES
16.1 The Board approves and announces the Rules of Etiquette, the local
Rules of the Game of Golf, and other internal legal documents of the
Club.
16.2 The Rules of Etiquette, the Rules of the Game of Golf, and other
requirements of the Club approved by the Board are mandatory for all
persons while at the Club.
17. LIABILITY
17.1 The Board is entitled to terminate a Membership Agreement and thus
to expel a Member from the Club for the Member’s failure to pay Annual
or other Dues and Fees on time, or for flagrant violation of the
Statutes, the Rules of Etiquette, the Rules of the Game of Golf, and
other requirements of the Club. In this case the Member will be
deprived of all his or her rights from the day of the Board decision
and he or she will not be refunded the Joining Fee and/or Annual Dues
he or she paid. The Membership will be sold and the Sales price minus a
25% administrative charge will be refunded within 60 days of the sale.
17.2 The Rules of Etiquette and the Rules of the Game of Golf may
envisage other cases when violations of the present Rules, the Rules of
Etiquette, and the Rules of the Game of Golf and other requirements of
the Club shall incur a warning or a fine or other sanctions to a
Member, Guest, Caddy or Visitor.
17.3 The Director shall solve all the issues related to the liability of persons visiting the Club or playing on its course.
18. FINAL PROVISIONS
18.1 The Statutes become effective when approved by the Club Board and
put up on the Club notice board and/or on the Club web page at www.golfclub.lt.
18.2 The Company reserves the right to change the Statutes at any time. The Statutes will be changed by the Club Board.
18.3 All Members and other persons visiting the Club can submit
comments and recommendations as regards amendments of or additions to
the Statutes and/or the Rules to the Director or other Staff members.
